Veamos:

La Ley 30151 promulgada el 13 de enero, exime a los efectivos policiales y del Ejército, de responsabilidad penal, cuando al hacer uso de la fuerza produzcan lesiones o muerte en el cumplimiento de su deber, incluso sin su arma de reglamento.

ES UNA LICENCIA PARA MATAR IMPUNEMENTE

Han protestado: El Alto Comisionado de Naciones Unidas, Amnistía I nter na ci onal , La Of i c i na de Washington para América Latina (WOLA), la Coordinadora Nacional de Derechos Humanos, la Defensoría del Pueblo, la Red Muqui. Como demostración de que “La ley es para cumplirse”, un policía mató a un mototaxista que estaba en su vehículo, que no tenía armas ni antecedentes penales. El policía dijo que el mototaxista pretendió atacarlo y el “guardíán del orden” no fue detenido, la ley lo ampara.

Comisionado del Diálogo calumnia desvergonzadamente

Vladimiro Huaroc, Alto Comisionado de la Oficina de Diálogo y Sostenibilidad de la Presidencia del Consejo de Ministros (PCM), ha vertido una catarata de desvergonzadas mentiras y calumnias contra los defensores del agua, por falta de espacio sólo mencionaremos algunas. Que no les interesa dialogar (vinieron a Lima los guardianes de las lagunas y ninguna autoridad quiso escucharles por qué defienden el agua y la vida). Que están ligados al narcotráfico del opio. Que las poblaciones que rodean Conga están de acuerdo con la minería. Que la mayoría de comunidades exige que el estado ponga orden en el lugar. Que han detenido y castigado a dirigentes. Que las comisarías que se instalarán son para que el Estado pueda ir a cumplir con las demandas de agua, saneamiento, electrificación. Que la decisión de los comuneros de no vender sus tierras a la hidroeléctrica que abastecerá a Conga no es de ellos sino de los grupos radicales antimineros. Que ante eso el Estado tendrá que tomar decisiones. Textualmente dijo: “Esta es una zona en que si el Estado no restablece el estado de Derecho, dados los antecedentes –corredor de droga, presencia autoritaria de sectores de rondas campesinas– puede devenir en descontrol y generar serios problemas al país”.

Si así habla el encargado del “diálogo”, se entiende que el resto del “Estado” usará la licencia para matar.

La gran prensa al servicio de las transnacionales desata campaña de calumnias contra la solidaridad internacional.

“El Comercio” afirma: “Los antimineros son financiados y organizados por una internacional comunista cuyo objetivo es mantener al país en la miseria”. “Santillana explicó a El Comercio que esta red de apoyo internacional tiene el objetivo de frenar el modelo de desarrollo económico del país basado en industrias extractivas”. “…. estas ONG financian los viajes de los líderes antimineros Edy Benavides y Milton Sánchez a varios lugares del mundo”. La valiente lucha de los defensores del agua en Cajamarca ha despertado solidaridad internacional: En Francia, en Suecia, en Irlanda, en Bélgica y en muchos otros países, brota, crece y se organiza la solidaridad con los heroicos y valientes defensores del agua y de la vida. Naturalmente, nuestros compatriotas, exilados económicos, están en la vanguardia de esa solidaridad, y haciendo sacrificio económico, pagan el viaje de quienes, en Cajamarca, luchan en defensa del agua, para que expongan en el exterior las noticias del ataque de las empresas extranjeras contra la vida y la salud del campesinado y del resto del pueblo peruano.

Esa solidaridad exterior con la lucha por la vida es calumniada por los sirvientes del gran capital como ataque contra el país.

Cortan la investigación por el asesinato de los defensores de la vida.

Las autoridades judiciales y los fiscales de Lambayeque, arrodillados ante el poder económico, aceptaron pisotear la ley y ocuparse de casos que estaban fuera de su jurisdicción, en el departamento de Cajamarca. A hora, cont i nuando c on ese servilismo, la Primera Fiscalía Provincial Penal de Chiclayo (Lambayeque) ha dispuesto improcedente formalizar y continuar la investigación preparatoria en el caso de las cuatro muertes en Celendín el 3 de julio de 2012, a pesar de reconocer la figura de homicidio doloso. Recordamos que los ciudadanos Paulino García Rojas, Faustino Silva Sánchez, Joselito Sánchez Huamán y a César Medina Aguilar, este último menor de edad, perdieron la vida tras la intervención de las fuerzas del orden en el marco de las movilizaciones de protesta contra el Proyecto Minero Conga. Esto, a pesar de que la fiscalía reconoce que la muerte del menor César Medina habría sido causada por un proyectil disparado desde uno de los helicópteros que sobrevoló durante los disturbios, corroborando lo que han afirmado varios testigos, pero no dispone que las investigaciones continúen en este punto. Alineada, junto con el gobierno, al servicio de los millones de la empresa, no quiere investigar el nivel de represión policial y militar que ha ocasionado la muerte de cuatro civiles desarmados (como reconoce la misma fiscalía). Éste fue un delito cometido antes de la ley de licencia de muerte.

Según datos de la Defensoría del Pueblo, ya suman 34 los asesinados impunemente por orden de Humala al servicio del gran capital transnacional. Falta espacio para la enumeración del resto de los ataques de la empresa millonaria y de sus sirvientes, el gobierno y otras autoridades el último mes.

Terminamos señalando:

El proyecto transnacional Conga, para ganar millones, pretende matar las lagunas de altura que nutren 600 manantiales en 5 ricos valles habitados por decenas de miles de campesinos peruanos, que beben esa agua y trabajan con ella en agricultura y ganadería, para nutrir de alimentos sanos al pueblo peruano.

Humala y las otras autoridades, arrodillados al servicio de los millones de las empresas, desarrollan la política de matar a balazos a los peruanos trabajadores pobres, defensores del agua y de la vida, en Cajamaca, Islay, Espinar y otras zonas.

Editorial: THEY ARE ASSASSINATING DEFENDERS OF WATER

Shooting down those who fight against destruction of the environment is the Humala government’s watchword.

Consider the following.  Law 30151, promulgated on 13 January, absolves units of the police and army from all culpability when, in the course of their duties, they cause injury or death, whether or not with regulation weapons.  This is a license to kill with impunity.

Among those who have protested the law are the United Nations High Commission, Washington’s Office for Latin America (WOLA), the National Coordinator for Human Rights, the Office for Defense of the People, and the Muqui Network.

As an indication that “the law is there to be implemented”, a policeman killed a taxi driver who sat in his own vehicle, unarmed and with no criminal record.  The policeman claimed that the driver was about to attack him, and this “protector of law and order” was not detained.  The law is sheltering him.

Vladimiro Huaroc, High Commissioner of the Office of Dialogue and Sustainability of the Council of Ministers has poured out a cataract of shameless lies and slanders against the defenders of water.  Because of space limitations, we will mention only a few of these:

• That they are not interested in dialogue.  In fact, the guardians of the lagoons went to Lima, and no authority was willing to listen to them, as the guardians are defending water and life.
• That they are connected to the drug trade.
• That populaces around the Conga project support the mine.
• That the majority of communities are demanding that the state keep order in their areas.
• That they have detained and abused public officials.
• That the commissions that are to be established are intended to allow the state to respond to the people’s needs for water, sanitation and electrification.
• That the communal landholders’ decision not to sell their lands to the hydroelectric company that will supply power to Conga comes from anti-mining radicals and not from the landholders, themselves.
• That, face with this, the state is obliged to render decisions in this matter.

Literally, what he said was that “this is a zone in which, if the state does not establish the rule of law, given the antecedents — drug running and the authoritarian presence of sectors of the peasant patrols — we could see a loss of control and the rise of serious problems for the country.”

If this is how the one in charge of “dialogue” speaks, it is understood that the rest of the state will make use of its license to kill.

The news media in the service of the transnationals has unleashed a campaign of slander against international solidarity.  El Comercio states that “the anti-mining forces are financed and organized by an international communist whose objective is to keep the country in misery.  …  Santillana explained to El Comercio that this international support network has as its objective to slow down the country’s economic development model based on extractive industries.  …  The NGOs finance the travel of anti-mining leaders Edy Benavides and Milton Sánchez to various parts of the world.”

The brave struggle by the Cajamarca defends of water has given rise to international solidarity.  In France, Sweden, Ireland, Belgium and many other countries it is budding, growing and organizing solidarity with the valiant defenders of water and life.  Naturally, our compatriots who have had to emigrate for economic reasons are in the vanguard of this solidarity and are prepared to make economic sacrifices for the cause.  They pay the passage of those who are fighting in defense of water in Cajamarca.  This allows the defenders to bring to other countries news of the foreign corporations’ assault on the life and health of the peasantry and the Peruvian people as a whole.  This solidarity is being maligned by the servants of big capital as an attack on the country.

The investigation into the murder of defenders of life is being cut short.  The judicial authorities and prosecutors of Lambayeque, on their knees before the economic powers, are willing to trample on the law and occupy themselves with matters outside their jurisdiction in the department of Cajamarca.  Continuing this servile attitude, the First Provincial Penal Prosecutor’s Office of Chiclayo (Lambayeque) has shown an unseemly reluctance to formalize and continue the preparatory investigation into the four deaths in Celendín on 3 July 2012, despite having admitted that this is a case of negligent homicide.  We are mindful that the citizens Paulino García Rojas, Faustino Silva Sánchez, Joselito Sánchez Huamán and César Medina Aguilar — the latter still a minor — lost their lives through intervention of the forces of order in the context of protest actions against the Conga Mining Project.  All this is in spite of the fact that the prosecutor’s office recognized that the death of the minor César Medina was caused by a projectile fired from one the helicopters flying overhead during the disturbance.  This corroborates the testimony of several witnesses, yet the authorities are unwilling to pursue investigations into the matter.  Lining up with the government in the service of the company’s millions, the prosecutor’s office does not want to investigate the level of police and military repression that the death of these four unarmed civilians has produced (as it has recognized).  And this crime was committed even before the license-to-kill law came into effect.

According to data from the Office for Defense of the People, the number of those assassinated with impunity on Humala’s orders in the service of transnational capital now stands at 34.  There is not enough space to enumerate all of the attacks during the past month by the millionaire enterprise and its servants, the government and other authorities.

Let us conclude by noting that the transnational Conga project, in its thrust to earn millions, plans to destroy the highland lagoons that feed 600 springs in five rich valleys inhabited by tens of thousands of Peruvian peasants.  These peasants drink the water and work with it in raising crops and livestock, which wholesome food for the Peruvian people.

Humala and other authorities, kneeling in supplication before the corporations’ millions, are defining a policy of shooting down the poor Peruvian workers, the defenders of water and life in Cajamarca, Islay, Espinar and other zones.
